verified Acceptance of Terms

These Terms of Service ("Agreement") constitute a legally binding contract between you ("Customer", "you", or "your") and Alpha Quantum d.o.o. ("Alpha Quantum", "we", "us", or "our") governing your access to and use of the Alpha Quantum enterprise AI platforms, APIs, and related services (collectively, the "Services").

By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you are entering into this Agreement on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these terms.

api Description of Services

Alpha Quantum provides enterprise AI platforms and APIs including but not limited to:

• Product Categorization API - Automated product classification across multiple taxonomies
• Website Categorization API - URL and domain classification using IAB and custom taxonomies
• Content Moderation API - Multi-modal content analysis and safety detection
• Redaction API - Automated PII, PHI, and PCI data detection and removal
• Anonymization API - Privacy-preserving data transformation and synthetic data generation

We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time with reasonable notice to enterprise customers.

manage_accounts Enterprise Accounts

To access our Services, you must create an account and provide accurate, complete, and current information. You are responsible for:

• Maintaining the confidentiality of your API keys and account credentials
• All activities that occur under your account, whether authorized or unauthorized
• Immediately notifying us of any security breaches or unauthorized access
• Ensuring your account information remains accurate and up-to-date

We may suspend or terminate accounts that violate these terms, exhibit fraudulent activity, or pose security risks to our platform or other customers.

speed API Usage & Rate Limits

Your use of our APIs is subject to the rate limits and usage quotas specified in your subscription plan or enterprise agreement. You agree to:

• Respect all published rate limits and implement appropriate retry logic with exponential backoff
• Not circumvent or attempt to bypass rate limiting mechanisms
• Use API responses only for their intended purpose as documented
• Implement proper caching strategies to minimize redundant API calls
• Not share API keys or allow third parties to access your account

security Data Processing & Security

Alpha Quantum implements enterprise-grade security measures to protect your data:

• All data transmitted to and from our APIs is encrypted using TLS 1.3
• Data at rest is encrypted using AES-256 encryption
• We maintain SOC 2 Type II, ISO 27001, and GDPR compliance
• Customer data is processed in accordance with our Data Processing Agreement (DPA)
• We do not use customer data to train our AI models without explicit consent

For services involving personal data, customers must ensure they have appropriate legal basis and consent for data processing in accordance with applicable privacy laws.

payments Billing & Payments

Subscription fees are billed in accordance with your selected plan or enterprise agreement. All fees are:

• Quoted and payable in US Dollars (USD) unless otherwise specified
• Non-refundable except as required by law or specified in your agreement
• Subject to applicable taxes, which will be added to invoices where required
• Due within 30 days of invoice date for enterprise customers

We reserve the right to modify pricing with 30 days advance notice. Price changes will not affect existing prepaid subscription periods.

block Prohibited Uses

You agree not to use our Services to:

• Reverse engineer, decompile, or attempt to extract source code from our APIs
• Resell, sublicense, or redistribute our Services without authorization
• Scrape, crawl, or use automated means to access our Services beyond authorized API usage
• Process data in violation of applicable laws or third-party rights
• Transmit malware, viruses, or other malicious code
• Interfere with the security or integrity of our Services
• Use our Services for competitive analysis or to build competing products
• Exceed your authorized usage limits or circumvent billing mechanisms

copyright Intellectual Property

All intellectual property rights in and to our Services, including but not limited to software, algorithms, models, documentation, and trademarks, remain the exclusive property of Alpha Quantum.

You retain all rights to your data. By using our Services, you grant us a limited license to process your data solely to provide the Services and improve our platform's performance and accuracy.

verified_user Service Level Agreement

Alpha Quantum provides enterprise customers with the following service commitments:

• Uptime: 99.9% monthly availability for production APIs
• Latency: Sub-100ms average response time for standard requests
• Support: 24/7 technical support with priority response for critical issues

Detailed SLA terms, including service credits for downtime, are specified in enterprise agreements.

gavel Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALPHA QUANTUM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

Our total aggregate liability shall not exceed the greater of (a) the fees paid by you in the twelve months preceding the claim, or (b) one thousand US dollars ($1,000).

shield Indemnification

You agree to indemnify, defend, and hold harmless Alpha Quantum and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the Services in violation of these terms
• Your violation of any applicable law or third-party rights
• Any data you submit to or process through our Services
• Any negligent or wrongful conduct by you or your authorized users

cancel Termination

Either party may terminate this Agreement:

• For convenience with 30 days written notice
• Immediately upon material breach that remains uncured for 15 days after notice
• Immediately if the other party becomes insolvent or bankrupt

Upon termination, your access to the Services will be revoked, and you must cease all use of our APIs. We will retain your data for 30 days to allow for data export, after which it will be securely deleted.

account_balance Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Republic of Slovenia, without regard to its conflict of law principles. Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the courts of Ljubljana, Slovenia.

For enterprise customers in the European Union, disputes may also be resolved through the European Commission's Online Dispute Resolution platform.
